Attorney: No charges against UT football player accused of rape

SAN ANTONIO -- San Antonio police will not file charges against the Longhorns football player accused of sexually assaulting a woman at a downtown hotel.

Perry Minton, the attorney for linebacker Jordan Hicks, issued the following statement in a press release on Wednesday:

"I just got off the phone with the San Antonio Police Department Detective in charge of the investigation of my client and he has informed me that no charges will be brought against Jordan Hicks or anyone else in this matter. The investigation is closed."

However, the San Antonio Police Department said the investigation is not closed. A spokeswoman said in an e-mail on Wednesday that the Special Victims Unit is still reviewing the case.

Minton sent a second email to KENS 5 in regards to the conflicting reports:

"I am going to let that work itself out with SAPD and the DA?s office. I stand by my statement that SAPD has notified us it is over."

Hicks and another player, who has not been official identified, were suspended from the team and sent home following allegations that they sexually assaulted a 21-year-old woman at the Holiday Inn Riverwalk.

The team was in San Antonio to play against Oregon State in the Alamo Bowl.

According to a police report, the alleged victim was an "acquaintance" with at least one of the players she met up with while partying at a nightclub.

The woman told officers she had several alcoholic drinks with the men before they went to the hotel bar at the Holiday Inn. She told officers she then invited both men back to her hotel room, where the alleged sexual assault occurred.

Minton had said in a written statement that Hicks "vehemently asserts" that the conduct under investigation by San Antonio police was "consensual by everyone involved."

Hicks will be returning to the University of Texas once school resumes from holiday break.
